Economic motivations are key drivers of human behavior. Unfortunately, they are largely overlooked in literature related to medical decisionmaking, particularly with regard to end-of-life care. It is widely understood that the directions of a proxy acting in bad faith can be overridden. But what of cases in which the proxy or surrogate appears to be acting in good faith to effectuate the patient’s values, yet doing so directly serves the decision-maker’s financial interests? Such situations are not uncommon. Many patients care (...) as deeply about economic wellbeing of their families as they do for their own lives and health. This brief work examines three scenarios that raise ethical issues regarding the role of pecuniary motives in making critical medical decisions. Each scenario presents a potential financial conflict of interest between an incapacitated patient and a third-party decision-maker and offers a framework for integrating ethical and legal concerns into clinical care. It is our hope that this work prepares physicians for unexpected ethical conflicts of interest and enables them to further the interests of his or her patients. (shrink)

In this article, we focus on the definition and application of the sliding scale of capacity. We show that the current interpretations of the sliding scale confound distinct features of the medical decision, such as its urgency, its severity, or its complexity, that do not always covary.We propose that the threshold for assessing capacity should be adjusted based solely on the cognitive complexity of the decision at hand. We further suggest that the complexity of a decision should be identified based (...) on a patient’s particular cognitive deficits. We utilize the current research on the types of deficits that characterize amnestic dementias and examine which types of medical decisions might be most complex for patients with that type of dementia. We conclude that applying the sliding scale based on individualized judgments of cognitive complexity will improve accuracy of assessment of capacity and enable capable patients to participate in medical decision making. Stackhouse’s affinity for both the Reformed tradition and the ideals of the Social Gospel movement are also evident throughout the text. In addition many of the essays reflect his ongoing engagement with the theme of “the global” and with globalization not only as a locus of critique but also as the vehicle for “the prospect of a world-comprehending culture, with a new recognition of certain common moral standards” (162).Whether these ideas are theologically helpful, however, is a matter of long-standing disagreement that will not be resolved in the limited space of this review. By treating the covenant between the Triune God and Israel as merely one instance of a “universal moral law,” and by moving from that particular to the universal through the doctrine of the Trinity, Stackhouse participates in a significant—and significantly problematic—strain of thought within the Christian imaginary (67). While he may reject the particularity espoused by George Lindbeck, Hauerwas, et al., he remains grounded within his own particularity with its own decidedly fraught history: that of the modern, progressive, Western civilizing project. As a work of moral theology, this text does have significant limitations. In this chapter we explore two important questions that we believe should be central to any discussion of the ethics and politics of cultural heritage: What are the harms associated with appropriation and commodification, specifically where the heritage of Indigenous peoples is concerned? And how can these harms best be avoided? Archaeological concerns animate this discussion; we are ultimately concerned with fostering postcolonial archaeological practices. Reflections by leading Latin American and African American philosophers on their identity within the field of philosophy.

Activism undertaken by CEOs has been on the rise in recent years. Research on this practice has been primarily concerned with determining the conditions under which a CEO’s public statements on sociopolitical issues are beneficial or detrimental to her firm’s business performance. We complement this instrumental perspective on CEO activism with an ethical investigation of the implications of CEO activism for the democratic process. Drawing on political philosophy, we show that the answer to the question of whether CEO activism is (...) conducive to the democratic process depends on the view of democracy that is adopted. From the perspective of liberalism, the sole requirement that an instance of CEO activism must fulfill is that it is lawful, provided that the applicable law sufficiently protects people’s essential rights. However, from the viewpoint of republicanism, this is not a sufficient condition. Besides being law-abiding, CEOs should be “civic-minded” when intervening in public debates, i.e., concerned with the quality and fairness with which those debates are conducted. Based on the literature on republicanism, we suggest four possible criteria that civic-minded CEOs can apply to gauge the democratic conduciveness of a possible public intervention: added insight, timeliness, constructiveness, and transparency. Our article complements the predominantly instrumentally oriented literature on CEO activism and contributes, more broadly, to the literature that explores the normative dimensions of corporate political involvement, as well as to a growing strand of research that draws on philosophical theory to inform business leaders’ ethical decision-making. In this chapter, the author finds problematic the distinction between “public philosophy” and philosophy done within the classroom or within academia, especially where this distinction implies an incommensurable difference, a pure separation, a clean break. The “public” is always already operative within the academically cloistered spaces of the classroom, and philosophical thinking is always already occurring outside the walls of academia. Philosophy is more than engaging in abstract thought experiments. The irony is that Euro‐American philosophical domination and canon formation take (...) place within the context of white hegemony and racist terrorism, the enslavement and brutalization of Black bodies, and the history of white colonialism. Philosophically engaging such issues as, say, whiteness, is not an add‐on to a syllabus that is otherwise raceless. Warren understands the importance of active racial coalition‐building but reminds progressive and liberal whites that white racism is always insidiously operating in their lives. (shrink)

Perinatal experience is posited as generative of psychogenesis: the psychological birth of the infant. The process involves a sentient human being rather than a nonconscious tabula rasa fetus. That birth experience is only traumatic is reductionist. The origins of positively colored affects as well as sexual feelings and even ecstasy may be intrauterine. The importance and complexity of the birth experience can better be described in terms of phases of being that parallel the physical stages of labor. These phases are (...) immanence, obstruence, descendence, experience, ascendence, emergence, and transcendence. Each of these phases encompasses a unique state and dynamic process. A l’inverse, et dans le même temps, les communautarismes revendiquent une identité inaltérable qui fait du Même l’organisateur du lien social, tandis que les fondamentalismes font des Ecritures le nouveau livre de sciences naturelles et de Dieu l’immense marché mondial des fanatismes. Rights and obligations—sometimes referred to as deontology or deontic powers—are key to most contemporary conceptions of social ontology. Both Cambridge Social Ontology and the dominant analytic conception associated, most prominently, with John Searle, place rights and obligations at the centre of their accounts. Such a common emphasis has led some to consider deontology to be a point of similarity between these different theories. This is a mistake. In this paper, I show that a distinctive conception of rights and obligations underpins (...) Cambridge Social Ontology and its social positioning theory. Moreover, I argue that a fuller understanding of the account of rights and obligations defended in Cambridge in fact reveals that it can be differentiated from other conceptions and, most importantly, Searle's, by its recognition that a practical dimension is always involved in social constitution.
